Copyright Policy and Notice & Takedown Procedures

This Association’s platform (the “Platform”) respects intellectual property rights and is committed to complying with applicable copyright laws and standard notice-and-takedown procedures. By using the Platform or uploading any content, you are deemed to have read, understood, and agreed to be bound by this Policy.

1. Copyright Ownership and User Responsibilities

All content uploaded to this Association’s platform (the “Platform”), including but not limited to text, photographs, images, videos, audio, music, short clips, and any other materials (collectively, the “Content”), remains the intellectual property of the original creator. Platform users (“Users”) are solely responsible for ensuring that the content they upload does not infringe any third-party copyrights. Users must obtain all necessary permissions from the relevant copyright holders or authorized agents prior to uploading such content. The Association does not require ownership of user-generated content and will not actively modify or re-license such content unless authorized under the Platform’s terms. However, by uploading or publishing content, Users grant the Association a royalty-free, transferable, sublicensable, worldwide, non-exclusive, perpetual, and irrevocable license to use, reproduce, adapt, and display such content for the operation of the Platform and related purposes, including but not limited to technical adjustments, translation, subtitle production, and platform development. The Association reserves the right to remove, restrict access to, or block any content that violates or is reasonably suspected of violating copyright laws or infringing third-party rights. Users shall indemnify and hold harmless the Association and its officers, directors, employees, agents, partners, representatives, shareholders, attorneys, predecessors, successors, and assigns from and against any claims, actions, losses, or expenses arising from infringement of third-party copyrights or violation of the Platform’s terms.

2. Copyright Infringement Notification Procedure

To submit a copyright complaint, the rights holder or their authorized representative must provide the Association with a signed notice containing:
  • Complainant’s details (name, address, contact number, and email);
  • Identification of the copyrighted work allegedly infringed;
  • Details of the infringing content (e.g., URL, screenshots);
  • Proof of copyright ownership;
  • A statement of good faith belief that the use is unauthorized;
  • A statement that the information provided is true and accurate, and acknowledgment that false statements are unlawful.

3. Counter-Notification Procedure

If a User believes their content has been removed in error, they may submit a counter-notification. The notice must be signed by the User and include:
  • User’s details (name, address, contact number, and email);
  • Identification of the removed content;
  • A statement of good faith belief that the removal or restriction was made in error;
  • Detailed reasons and supporting evidence;
  • Whether the User consents to the disclosure of personal data in the notice to the complainant;
  • A statement that the information provided is true and accurate, and acknowledgment that false statements are unlawful.

4. Failure to Comply with Notification Procedures

If the copyright holder or User fails to submit a proper notice, the Association may have no obligation to take action. However, the Association reserves the right to take measures to mitigate legal risks, including restricting access to or removing infringing materials.

5. User Responsibilities and Repeat Infringers

Users must fully comply with copyright laws. The Association reserves the right to suspend or terminate the accounts of repeat infringers who continuously violate copyright laws.

6. Legal Compliance

The Association complies with applicable copyright laws in the jurisdictions in which it operates and follows standard notice-and-takedown procedures, including allowing the use of technological measures adopted by copyright holders to protect their works.

8. Interpretation

In the event of any inconsistency between the English version and versions in other languages, the English version shall prevail.
